Right of withdrawal
You have 14 days to change your mind when you buy online from a trader. How to do it, what cannot be returned, and the model form.
Piața Neamț does not conclude sales contracts. The right of withdrawal is exercised against the seller in the producer's shop, who sold to you.
When you have the right
If you bought a product at a distance (online, by phone or e-mail) from a seller acting as a trader, you can withdraw from the contract within 14 calendar days without giving a reason. The period runs from the day you, or someone you named, received the product. Legal basis: Directive 2011/83/EU and Romanian Government Emergency Ordinance (OUG) 34/2014 on consumer rights.
If you bought from a private person with no economic activity, the right of withdrawal does not apply. The shop says so before you order.
How to use it
- Send the seller a clear statement that you withdraw: by e-mail, post or with the model form below. The seller's details are on the shop page.
- You may use the model form but you do not have to. What matters is sending the statement before the 14 days end.
- If the seller offers an electronic withdrawal function in their shop (from 19 June 2026 under Directive (EU) 2023/2673, for sellers who let you conclude contracts online), you can use it.
- If you cannot find the seller's details, write to the contact point and we will pass your message on.
What happens next
- The seller refunds everything you paid, including standard delivery, within 14 days of learning that you withdrew. They may hold the refund until they get the product back or you show you sent it.
- You send the product back within 14 days of your statement. Usually you pay the cost of return, unless the seller agreed to pay it or did not tell you about it.
- You are liable for a loss in value only if you handled the product more than needed to check its nature and function.
What cannot be returned
The right of withdrawal does not apply, among other cases, to:
- products made to your specification or clearly personalised (for example a craft item made to order);
- products that can spoil or expire quickly;
- sealed products that cannot be returned for health or hygiene reasons, if unsealed after delivery.
Shops mark these products before you order. The full list of exceptions is in OUG 34/2014, art. 16.
